Throughout these terms and conditions Le-Curve means www.le-curve.com. 

This website is operated by Le-Curve. The term “site” refers to this website. Throughout the site, the terms “we”, “us” and “our” refer to Le-Curve. The terms “you” and “your” refer to all users of the site. These terms and conditions govern your use of www.le-curve.com and the purchase of goods or services from the site. By continuing to access this site you are accepting and consenting to these terms & conditions, which may be updated at any time - we therefore recommend a regular visit to this page. Your continued use of the site signifies your agreement to any modified terms and conditions including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These headings used in these terms and conditions are included for convenience only and will not limit or otherwise affect these terms and conditions.

AGE & USE OF THIS SITE
Only persons aged 18 & over and who possess the required legal authority are entitled to use this site. You may not use this site and/or our products and services for any illegal or unauthorized purpose. We reserve the right to refuse to transact with anyone for any reason at any time without further explanation.

Our store is hosted on Shopify Inc. Shopify provides us with the online e-commerce platform that allows us to sell our products and services to you.

PRIVACY POLICY

GOVERNING LAW
These terms and conditions and every transaction will be governed by and interpreted in accordance with the laws of England and Wales.

CONTRACT/AGE OF MAJORITY
No contract will exist between you and Le-Curve for the sale of any product until Le-Curve has accepted and despatched your order excluding bespoke or personalised orders – please see “Bespoke and Personalised Orders” below. Our acceptance of your order brings into existence a legally binding contract between us. Only persons aged 18 & over and who possess the required legal authority are entitled to enter into these legally binding contracts. We reserve the right to cancel any order without giving reason or notice and will refund you the full amount.

PRODUCTS & SERVICES
All our products and services are exclusively available through this site. Whilst we have made every effort to display on our site the colours, sizes, shapes, textures and images of our products as accurately as possible we cannot guarantee that your computer monitor, tablet, smartphone or other digital device will display these colours, sizes, shapes, textures and images accurately. These possibilities play a significant part in the provision of our generous, customer-focused returns policy (here). We reserve the right to limit the quantities of any products or services that we offer or to discontinue certain products or services without prior notice. We also reserve the right but are not obligated to limit the sales of products or services to any person, geographic region or jurisdiction without prior notice. All descriptions of products or services are subject to change without prior notice at our sole discretion.

TERMS OF SALE - EXCLUDING BESPOKE OR PERSONALISED ORDERS
By placing an order you are offering to purchase a product subject to these terms and conditions. All orders are subject to availability and confirmation of the order price. We must receive the payment in whole. Once payment has been received by us we will confirm that your order has been received by sending an email to you at the email address you provide in your order form. Our acceptance of your order takes place on the despatch of our products to you unless we notify you that we do not accept your order, or you have cancelled your order, or unless the order is for a bespoke or personalised item (see “Bespoke and Personalised Items” below).

BESPOKE & PERSONALISED ORDERS
If you wish us to contact us about bespoke or personalised version of any of our products please email us at info@le-curve.com enclosing a detailed description of your requirements. If we agree to undertake any such work we will email you detailing our understanding of your requirements, an approximate date by which the order will be ready for despatch and a quote for the price. Work will not commence until we have received your written consent for the work to go ahead on the bases we send you in writing and you have paid the full amount. Our cancellation policy for orders under this provision are as follows: Where work has not yet commenced, if you cancel the order you will receive a refund of the price paid less an administrative fee of £100. Where planning and design work has commenced but no production work on the item(s) has begun, if you cancel your order you will receive a refund of three quarters of the price paid. Once work has begun on the production of your order no refund is possible.

FIVE YEAR GUARANTEE
We take great pride in the time, expertise and the quality of workmanship that go into the making of every piece of our jewellery. We want you to have the same faith in us and in our products as we do. We therefore guarantee all our products against defective workmanship for a period of five years. We will repair, replace or refund the item as we deem appropriate and we will bear the returns and re-delivery costs. This excludes normal wear and tear, damage caused by force or as a result of failing to follow the advice given in our “care for your jewellery” section.

ACCURACY OF BILLING & ACCOUNT INFORMATION
We are focused on processing and despatching all accepted orders as quickly and efficiently as possible. In order to assist us in this endeavour, you agree to provide accurate, current and complete purchase information for all purchases made on this site. This includes your email address, your credit card details and other contact details so that we can complete your transaction and contact you as needed. You agree to keep your account information current and confidential.

ORDERING ONLINE
Ordering Online with us is safe and secure and we do not store any financial information. We use a payment processing partner who is certified to PCI Service Provider Level 1 (that is the highest you can get). We also use Secure Sockets Layer (SSL) encryption on our payment, login and registration pages to keep your data secure.

ONLINE ORDER CANCELLATIONS-EXCLUDING BESPOKE OR PERSONALISED ORDERS
If you wish to cancel an order please email us immediately at info@le-curve.com. Orders can be cancelled at any time before they are despatched. If your order has already been despatched, we will be unable to redirect or recall it therefore please return the parcel for a refund when it is received. For further details on returns, click here (here). Please note that we cannot accept cancellations for bespoke orders or personalised orders once work on them has begun.

PRICES
The prices payable for goods are shown on the product pages and are correct on the date the customer places the order. All prices are in UK Pounds. Prices shown in any of our printed materials (except for errors/omissions) are correct at the time of printing. All our prices are subject to change without any prior notice.

DISCOUNT CODES
We may offer promotional discount codes, which may apply in respect of orders made at Le-Curve. These codes may only be used on full-price items and cannot be used in conjunction with any other offer or discounts. We retain the right to withdraw or cancel a discount or promotion at any time.

DELIVERY
We deliver all of our products free of delivery charges within the UK. Please note that we regret we are unable to offer our products for sale internationally at the current time. Items will be sent to the delivery address provided at time of order – it is your responsibility to ensure this is correct. If your order is returned to us because the courier or the postal service could not complete the delivery to you for whatever reason, then you will be responsible for the repeat delivery costs. The delivery prices for orders are set out in our “Delivery & Returns” section (here).

RETURNS
Goods purchased from Le-Curve may be returned free of charge within 90 days of purchase for any reason providing that the items are in their original condition & packaging. This does not affect your statutory rights. Bespoke or personalised items, for example special orders, engraved orders etc are non-returnable, non-refundable and non-exchangeable. You can find all the information you need in our “Delivery and Returns” section (here).

LATE OR LOST DELIVERIES
We cannot refund or replace lost items until 20 working days after the date of despatch. Royal Mail deems items as “lost” after this amount of time. We advise all items are delivered to home addresses; if an item is delivered to an office, for example, it can sometimes go missing if signed for by a colleague or left in an unknown place.

LIABILITY
If the goods we deliver are incorrect, damaged or incorrect in quantity, we shall have no liability to you unless you notify us by email of the problem within 7 working days of receipt.
If you do not receive goods ordered within 5 working days from the date of despatch we shall have no liability to you unless you notify us of the problem urgently by email. If you notify us of a problem under this condition, our only obligation will be to redeliver, refund or replace any damaged item. We cannot be held responsible for any delays once the goods have left us and are in possession of the courier or Royal Mail.

LIMITATIONS OF LIABILITY
So far as permitted by law, we exclude any liability for loss or damage of any kind resulting from the use of the site.

The entire content of the website, including all designs, copyright, trademarks and other intellectual property rights, including the use of the name Le-Curve is the sole property of Le-Curve and its licensors. You are not permitted to publish, distribute, manipulate or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this website, nor may you use any such content in connection with any business or commercial enterprise.

ACCESS
Access to this website is permitted on a temporary basis, and we reserve the right to withdraw or amend the services without notice. We do not guarantee that this site will meet your requirements or will be uninterrupted, timely or error-free, that errors will be corrected, or that this site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the materials. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through this site.

SEVERABILITY
If any provision in these Terms and Conditions is held to be illegal or invalid for any reason, the illegality or invalidity shall not affect the remaining provisions hereof, but such provision shall be fully severable and these Terms and Conditions shall be interpreted and enforced as if the illegal or invalid provision had never been included.

ENTIRE AGREEMENT
These terms and conditions set out the entire agreement between you and Le-Curve in respect of the sale, purchase and use of our goods. They replace any previous agreement or understanding in relation to the subject matter hereof. No variation of these terms and conditions are binding on us unless agreed by us in writing.
